Cancellations

Please be aware that there are no pro-rated refunds. If you wish to cancel your service, cancellation will be effective on the last day of the quarter in which the cancellation was requested.

Billing Cycles

We bill all hosting accounts quarterly or annually unless other special arrangements as made. We bill on the first month of the quarter for service. If you signup on a date other than the first month of a quarter, a pro-rated amount will be charged for the remainder of the present quarter.

Billing

All accounts are billed by credit card unless special arrangements are made. You are responsible for notifying Avrom of any changes to your credit card (including, but not limited to card number, expiration date, billing address, or card status). Please note that it is your responsibility to keep your account and contact information current.

Refunds

We do not offer credits or refunds for hosting time already expended and domain name registration fees are non refundable. Because we have provided you with DNS entries, usernames, passwords, appropriated disk space, bandwidth/data transfer and other resources, you are provided with the ability to use your account. If you do not use the services you are ordered, are still obligated to pay for the account. The reason for this policy is that even an unused account uses valuable system resources that we could have made available to offer other customers and therefore, once you have ordered our services you are obligated to pay for your account.

Use of Services

All services provided by Avrom’s Web Host may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

System and Network Abuse

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network; interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Spam Policy

Avrom's Web Host is committed to a zero-tolerance, anti-spamming policy. Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited, regardless of whether or not it overloads a server or disrupts service to our customers. The term "spamming" also includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a web site hosted on an Avrom server, and selling or distributing software (on a web site residing on an Avrom Hosting server) that facilitates spamming. Violators will be assessed a minimum fine of $100 and will face immediate suspension. Avrom reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this provision.

Adult Content

Avrom's Web Host does not allow the publishing of any pornographic materials on the web servers.

Disclaimer

Avrom's Hosting service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Avrom expressly disclaims any representation or warranty that the Avrom Web Hosting service will be error-free, secure or uninterrupted. No oral advice or written information given by Avrom, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Avrom and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT, AND UNDER NO THEORY OF LAW OR EQUITY, WILL AVROM BE LIABLE FOR THE LOSS OF A DOMAIN NAME, OR ANY BUSINESS OR PERSONAL LOSS, REVENUES DECREASE, EXPENSE INCREASE, COSTS OF SUBSTITUTE PRODUCTS AND/OR AVROM'S SERVICES, OR ANY OTHER LOSS OR DAMAGE WHATSOEVER, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF ANY USE OF, OR ANY INABILITY TO USE, ANY AVROM WEB HOSTING SERVICES EVEN IF AVROM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Refusial of Service

We reserve the right to refuse, cancel, or suspend service at our sole discretion
